StreamPress Terms and Conditions

1. Acceptance of Terms

Welcome to StreamPress (www.streampress.com). By accessing and using the StreamPress website and its services (“Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use our Services. 

2. Description of Services

• License: By uploading User Content, you grant StreamPress a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and StreamPress’s business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels.   
• Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights, licenses, and permissions to use and authorize StreamPress to use your User Content.   
• Prohibited Content: You agree not to upload, post, or transmit any User Content that:
  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.  
  • Infringes any intellectual property rights of any party.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.   
  • Violates any applicable laws or regulations.

5. Intellectual Property

• StreamPress IP: All content, trademarks, service marks, trade names, logos, and other intellectual property displayed on the Services are the property of StreamPress or its licensors. You agree not to use, reproduce, or distribute any StreamPress intellectual property without our prior written consent.
• Copyright Infringement: If you believe that your copyrighted work has been infringed, please provide us with a written notice containing the following information:
  • Your contact information.
  • A description of the copyrighted work that you claim has been infringed.  
  • A description of where the material that you claim is infringing is located on the Services.  
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.  

6. Payment and Subscription

• Fees: Certain Services may be subject to fees. You agree to pay all applicable fees in accordance with the pricing and payment terms presented to you.  
• Subscription: If you subscribe to a paid plan, your subscription will automatically renew unless you cancel it.

STREAMPRESS DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.   

8. Limitation of Liability

IN NO EVENT SHALL STREAMPRESS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES; OR (F) ANY USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY.  

9. Indemnification

You agree to indemnify and hold StreamPress and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Services, your User Content, or your violation of these Terms.  

10. Governing Law
